Terms of Service for LinkSouls.AI

Welcome to LinkSouls.AI ("we," "us," or "our"). We offer an AI-powered companionship platform (the "Services") built on a unique "Privacy Vault" architecture. Our Services are designed to provide deep, lasting connection, empowering you with absolute control and privacy over your personal interactions.

These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and all related services (collectively, the "Services"). By accessing or using the Services, you ("you" or "user") agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and LinkSouls.AI (operated by `Viswise Consulting Limited`). We may amend these Terms from time to time (see Section 13 for details). Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Services

LinkSouls.AI offers AI-powered emotional companionship services. Our Services are fundamentally different from other platforms:

  • Privacy-First Architecture: Your `Interaction Data` (conversations, images, memories) is end-to-end encrypted and stored exclusively on your local device. We do not store or have access to your readable conversation history.
  • Persistent On-Device Memory: We provide personalized features (like our "Relationship Engine") which function using the encrypted data stored on your device, not by analyzing your data on our servers.
  • Ephemeral Processing: To generate AI responses, your data is processed in-memory on our servers and then instantly discarded. We do not keep it. (See our Privacy Policy for full details).

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice, and shall not be liable to you for any such action.

3. Eligibility and Account Registration

  • Age Requirement: YOU MUST BE 18 YEARS OF AGE OR OLDER to use the Services.
  • Our Services are an adult-oriented platform offering complex, mature emotional themes. We explicitly prohibit any individual under 18 years old from using the Services.
  • By registering, you represent and warrant that you are 18 or older. We require all users to verify their age range during registration. If we confirm that a user is under 18, we will immediately terminate their account and delete all associated Account Information, in line with our Content Policy and Privacy Policy.
  • Account Creation: To access certain features, you must create an account by providing accurate, current, and complete information (e.g., email address, age range) and maintain its accuracy. You are responsible for safeguarding your account credentials (username, password) and for all activities conducted under your account.
  • Account Responsibility: You agree to notify us immediately of any unauthorized use of your account by contacting `vip_service@linksouls.com`. We shall not be liable for any loss or damage arising from your failure to protect your account.

4. User Conduct

You agree to use the Services in compliance with these Terms, our Content Policy, all applicable laws, and ethical standards. Prohibited conduct includes, but is not limited to:

  • Using the Services for illegal, harmful, or fraudulent purposes.
  • Uploading, transmitting, or generating content that is prohibited by our Content Policy, including:
    • Obscene, pornographic, or sexually explicit content.
    • Content exploiting minors in any way (ZERO TOLERANCE).
    • Violent, threatening, harassing, or discriminatory content.
    • Content that infringes on third-party rights (including copyrights or privacy).
  • Impersonating any person or entity, including our AI Agents or employees.
  • Attempting to access, modify, or disable any part of the Services (e.g., hacking, scraping, or introducing malware).
  • Interfering with other users’ access to the Services.
  • Using the Services to solicit personal information from anyone, especially minors.
  • Reselling, licensing, or commercially exploiting the Services or AI Agents without our prior written consent.

5. Content and Intellectual Property

5.1 Your Content (Private Interaction Data)

  • You retain 100% ownership of the content you generate in your private conversations (your "User Content").
  • Because your User Content is stored end-to-end encrypted on your device and we cannot access it, you do not grant us any license to read, use, reproduce, modify, or distribute your private conversation content.
  • You grant us a limited, necessary, and purely technical license only for the act of "Ephemeral Processing" (i.e., transmitting and processing your data in-memory to generate an AI response, and then immediately discarding it). This license is purely technical, grants us no rights to your content, and does not permit us to store or train on it.

5.2 User-Uploaded Media (for AI Creation Features)

For content you voluntarily upload to specific features (like the "Magic Brush"), you grant us a limited license only to process that media, generate the new AI image, and return it to you. As stated in our Privacy Policy, these images are not permanently stored on our servers or used for training.

5.3 Our Content and AI Agents

All content provided through the Services, including text, graphics, software, AI Agent responses, and trademarks ("Our Content"), is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

AI Agents are our proprietary technology. You may not copy, modify, reverse-engineer, or create derivative works of AI Agents or their responses without our explicit written permission.

6. Disclaimers and Limitations of Liability

  • AI Limitations: AI Agents generate responses based on algorithms and data. Their content is for entertainment, emotional support, and general companionship only. It does not constitute professional advice (legal, medical, psychological, or otherwise). You should not rely on AI Agent responses for critical decisions. Always consult a qualified human professional for such advice.
  • No Guarantee of Service: We do not guarantee that the Services will be uninterrupted, error-free, or secure. We may restrict access to certain features or AI Agents at our discretion.
  • Third-Party Risks: The Services may link to third-party websites or services (like our payment processor). We are not responsible for their content, privacy practices, or availability.
  • Limitation of Liability: To the maximum extent permitted by law, LinkSouls.AI and its parent entity `Viswise Consulting Limited` shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of data, emotional distress, or reputational harm. Our total liability to you shall not exceed the amount you paid for premium services in the 12 months prior to your claim.

7. Term and Termination

  • Term: These Terms remain in effect as long as you use the Services.
  • Your Right to Terminate: You may delete your account at any time. As detailed in our Privacy Policy, your `Interaction Data` (conversations and memories) exists only on your device. When you delete this data from your device or uninstall the app, it is gone forever. Deleting your account will permanently erase the limited Account Information (e.g., your email) stored on our servers.
  • Our Right to Terminate: We may suspend or terminate your access to the Services immediately, with or without notice, if: (i) you violate these Terms or our Content Policy (especially the 18+ rule); (ii) your use of the Services harms us or other users; (iii) required by law; or (iv) we discontinue the Services. Upon termination, all licenses granted to you under these Terms will cease.

8. Premium Services

  • Subscription Terms: Premium features (e.g., our `Inner Circle` membership) require payment and are governed by these Terms and any additional subscription terms provided at checkout.
  • Billing: You agree to pay all fees associated with premium services. We use a third-party payment processor (Stripe), and your payment information is governed by their privacy policy.
  • Renewal: Subscriptions auto-renew unless canceled. You may cancel auto-renewal through your account settings or by contacting `vip_service@linksouls.com`. For refund policies, see our Cancellation & Refund Policy.

9. Privacy

Your use of the Services is governed by our Privacy Policy, which is a core and legally binding part of this agreement. Our Privacy Policy details our unique "Privacy Vault" and "Ephemeral Processing" architecture. By agreeing to these Terms, you also agree to the practices described in the Privacy Policy.

10. Governing Law

  • If you are not a consumer in the European Economic Area ("EEA"), these Terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China (the "Hong Kong Laws"), without regard to its conflict of law provisions.
  • If you are a consumer in the EEA, these Terms are governed by the laws of the country of your habitual residence, without regard to its conflict of law provisions. As an EEA consumer, you shall enjoy the protection afforded by the mandatory provisions of the law of your country of residence.

11. Dispute Resolution

Informal Resolution:

We strongly encourage you to resolve disputes informally first. Before initiating any formal legal proceedings, please contact us at `vip_service@linksouls.com` to explain your concerns, and we will work with you in good faith to seek a mutually acceptable solution.

Formal Disputes:

  • If you are not a consumer in the EEA, any legal action arising out of or relating to these Terms shall be filed in the High Court of the Hong Kong Special Administrative Region. You and LinkSouls.AI agree to submit to the personal and exclusive jurisdiction of the High Court of Hong Kong, and the venue for such proceedings shall be Hong Kong.
  • If you are a consumer in the EEA, you may bring a claim to enforce your consumer protection rights in connection with these Terms either in the High Court of the Hong Kong Special Administrative Region or in the competent courts of the EEA member state where you have your habitual residence.

Consumer ADR: We are neither willing nor obligated to participate in dispute resolution proceedings with consumers before a consumer arbitration board under the EU Directive on Consumer Alternative Dispute Resolution (ADR).

12. Entire Agreement

These Terms, together with our Privacy Policy, Content Policy, and Cookie Policy, constitute the entire agreement between you and LinkSouls.AI regarding the Services, superseding all prior agreements.

13. Changes to These Terms

We may update these Terms by posting the revised version on our website. The "Effective Date" will be updated to reflect the change. For material changes, we will notify you via email or in-app notification at least 30 days before the changes take effect. Your continued use of the Services after the effective date confirms your acceptance of the revised Terms.
