Copyright & DMCA Policy for LinkSouls.AI

LinkSouls.AI ("we," "us," or "our") respects the intellectual property rights of others and expects users of our platform (the "Services") to do the same. This policy outlines our procedures for addressing copyright infringement, primarily in compliance with the Digital Millennium Copyright Act (DMCA).

1. Scope of This Policy: Public vs. Private Content

This policy, including the DMCA procedures below, applies exclusively to "Public Content" on our Services. "Public Content" refers to any content, AI agent profiles, or images that users create and voluntarily make accessible to other users or the public (e.g., sharing in a public gallery, publishing an AI Soul profile).

This policy does not and cannot apply to your "Private Interaction Data". As detailed in our Privacy Policy and Terms of Service, your private conversations with your AI Souls are end-to-end encrypted and stored exclusively on your local device. We do not have the technical ability to access, review, or remove this private, encrypted content. You are solely responsible for the content of your private interactions.

2. Copyright Ownership

  • Our Content: All content owned or licensed by LinkSouls.AI, including our software, AI agent base designs, and trademarks, is protected by intellectual property laws and is owned exclusively by us or our licensors.
  • Your Content: You retain ownership of the content you create. For any "Public Content" you choose to share, you grant us a license to host, display, and distribute it as necessary to operate the Services (as detailed in our Terms of Service). You are solely responsible for ensuring your "Public Content" does not infringe the copyrights or other rights of third parties.

3. Prohibition of Copyright Infringement

We strictly prohibit the posting of "Public Content" that infringes the copyrights of any third party. This includes, but is not limited to:

  • Uploading copyrighted images as a public AI Soul avatar.
  • Publishing text (e.g., in a public AI Soul bio) that is copied directly from a copyrighted work.
  • Sharing AIGC images in a public gallery that are clear derivatives of a copyrighted work.

4. DMCA Takedown Procedure (for Public Content)

Upon receiving a valid DMCA notice, we will take prompt action to remove or disable access to the allegedly infringing "Public Content" and notify the user who posted it.

4.1 Requirements for a Valid DMCA Notice

A copyright owner or their authorized agent must submit a written notice to our Copyright Agent containing the following:

  • A physical or electronic signature of the copyright owner (or their agent).
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the "Public Content" on our Services claimed to be infringing, with specific details sufficient to locate it (e.g., URL to the public AI Soul profile, link to the public gallery image).
  • Contact information for the complaining party (name, address, telephone number, email).
  • A statement that the complaining party has a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the copyright owner.

4.2 Submission of DMCA Notices

Send valid DMCA notices to our designated Copyright Agent:

  • Mail: LinkSouls.AI Copyright Agent, c/o Viswise Consulting Limited, Room 2705, 27th Floor, China Resources Building, 26 Harbour Road, Wan Chai, Hong Kong

5. Counter-Notification (for Public Content)

If you believe your "Public Content" was removed by mistake, you may submit a counter-notification ("Counter-Notice") to our Copyright Agent. A valid Counter-Notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed due to mistake or misidentification.
  • Your name, address, telephone number, email, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., to the jurisdiction of the courts of Hong Kong), and that you will accept service of process from the complaining party.

Upon receiving a valid Counter-Notice, we will forward it to the original complaining party. We may restore the material in 10-14 business days unless the complaining party notifies us they have filed a lawsuit.

6. Repeat Infringers

We will terminate the accounts of users who are determined to be "repeat infringers" of "Public Content" copyrights, in accordance with our policies.

7. Disclaimer

We do not pre-screen or monitor "Public Content" for copyright infringement. As stated in our Terms of Service, we disclaim liability for any copyright infringement by our users, but will respond promptly to valid DMCA notices as required by law. We have no ability to monitor, access, or remove any "Private Content" stored on your device.

8. Changes to This Policy

We may update this policy. Material updates will be posted on our website and app. Your continued use of the Services after the effective date constitutes acceptance of the revised policy.
